1.1. Applicable regulations

Our privacy policy has been designed in accordance with the EU General Data Protection Regulation 2016/679 of the European Parliament  and Council, of 27 April 2016, in regard to the protection of physical persons regarding the processing of personal data and free circulation of these data and whereby Directive 95/46/EC (General Data Protection Regulation), and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights are repealed.

By providing us with your data, you hereby manifest having read and being familiar with this privacy policy and give your unequivocal and express consent to the processing of your personal data in accordance with the purposes and terms set out herein.

2. PURPOSE OF PROCESSING THE PERSONAL DATA

We process your personal data for the following purposes:

- To provide you with information in regard to the products offered by our company and outlined on this website.

2.1. Data storage period

We will store your personal data from when you give us your consent until you revoke this or request limitation of the processing. In such cases, we will keep your data blocked for the legally required periods.

In the event of purchasing our products, the data will be stored for as long as necessary to manage the order, follow this up and be able to invoice and perform our accounting and tax obligations. The data will subsequently be stored for the prescription periods to which the Data Protection Officer is legally obliged.

3. LEGITIMACY AND DATA COLLECTED

The legitimacy for processing your data is the express consent granted by means of a positive and affirmative act (fill in the corresponding form and tick the box to accept this policy) when you provide us with your personal data.

3.1. Consent to process your data

When filling in the forms, tick the box “I accept the Privacy Policy” and click to send your data or when sending e-mails to the Company by means of the accounts authorized for this purpose. The data collected refer to the data category for identifying data such as: Name and Surname, Phone number, Postal address, Company or e-mail.

4. Restricted access area policy for customers

To access restricted areas, users should have the corresponding access codes. The Company reserves the right to freely accept or reject the request to register any user. The data entered by users should be accurate, current, true and will be processed in compliance with prevailing legislation on personal data protection.

Users will be responsible in any event for the custody of their access codes, whereby they will be exclusively responsible for any damage that might arise from incorrect use of these, as well as loss or any other circumstance that might entail an access risk from use of the same by unauthorized third parties. Users should notify this immediately to the company so that they proceed to block and replace the access.

 

5. SECURITY MEASURES

Within our undertaking to guarantee the security and confidentiality of your personal data, we hereby notify you that the technical and organizational measures needed to guarantee the security of personal data and avoid their amendment, loss, processing or unauthorized access have been adopted; taking into account the state of the technology, the nature of the data stored and the risks to which they are exposed, according to Art. 32 of the EU GDPR 679/2016.

6. TRANSFER OF DATA

The only transfers foreseen are those needed for orders to reach the destination specified by the user.  

There are suppliers responsible for processing, with whom there are signed contracts required by regulations, in accordance with article 28 of the GDPR.

Outside of this scope, there is no data or international data transfer, except those approved by tax, mercantile and telecommunications legislation as well as in those cases in which a judicial authority so requires of us.

 

7. RIGHTS OF THE USER

Any interested party has the right to obtain confirmation on whether or not we are processing personal data that affect them. Interested parties have the right to access their personal data, as well as request correction of inaccurate data or, as appropriate, request their deletion when, among other things, the data are no longer necessary for the purposes for which they were collected. Under certain circumstances, interested parties may request limited processing of their data, whereby we will store them solely for the exercise or rebuttal of complaints. For reasons related to their individual situation, interested parties may oppose processing of their data. The person responsible will stop processing the data, except for imperative legitimate reasons or the exercise or rebuttal of possible complaints.

A)-RIGHT OF ACCESS

Article 15 of the General Data Protection Regulation recognizes the right of the interested party to ascertain whether or not their personal data are being processed, the data categories, the addressees, the origin of the data, the storage period and the criteria to determine this period. Therefore, the data protection officer will provide a copy of the personal data under processing by means of an electronic form prior to presentation of the request.

The data protection officer can also be asked to correct, delete or limit data and processing.

B)-RIGHT OF CORRECTION AND DELETION

Articles 16 and 17 of the General Data Protection Regulation set out in regard to correction and deletion of personal data that the customer or user requests correction of his personal data because of considering these inaccurate or that these be completed or deleted because they are unnecessary for the purposes for which they were collected and processed.

C)- RIGHT TO LIMITATION OF PROCESSING

The interested party will have the right to obtain from the data protection officer limited processing of her data as long as the accuracy of the personal data is contested. That is, the data may only be processed, except when they are held with the consent of the interested party, for exercise or rebuttal of complaints, to protect the rights of another physical or legal person or for reasons of public interest of the European Union or a certain member state. D) RIGHT TO THE PORTABILITY OF DATA

Article 20 of the General Data Protection Regulation recognizes the right of the interested party to receive the personal data incumbent on them; that is, they are sent directly from data protection officer to data protection officer, as long as this is technically possible, in a structured, common use and mechanically read format, without this being hindered by the data protection officer they were given to, when the consent has been expressly externalized or by means of contract.

8. MINORS

The website’s content is not targeted at those aged under 18. Moreover, and for the specific case of data that the user provides, only users under 14 or more can give their free consent for their data to be processed.

In any event, the Company will take all possible measures to verify users’ age, but cannot be held responsible for any breach in this sense.

 

9. CONFIDENTALITY

The personal data that may be collated will be processed in full confidentiality. International Data Transfer is understood as that communication of your personal data to countries outside the European Union, and more specifically outside the European Economic Area (EEA).
